  • Is your mark capable of acting as an indicator of origin for the goods/services it distinguished?
    Your mark, should possess sufficient distinctiveness, so that it can distinguish your goods/services from those of other undertakings. It should also not be descriptive.
  • Is your trademark available for use and/or registration?
    If your trademark has been registered by a third part, then you will not be able to apply for its registration. Prior to filing an application, extensive research is required in order to ensure that it is free both to be registered and/or used.
  • Does your trademark cover the markets that are of interest to you?
    The territorial scope of protection that trademarks offer is geographically limited, which means that in other markets (countries) your trademarks may not be available.
  • Is your trademark that, which you will actually use?
    Your trademark should be applied for, exactly in the form that it will be used. Following a five year term, following its registration, the trademark will be liable to be revoked if it has not been put to genuine use.
  • Have you drafted an accurate, comprehensive and realistic specification of goods/services that your trademark will distinguish?
    It is very important, that prior to the filing of a trademark application, you have drafted the appropriate specification of goods/services that your trademark will distinguish. Following the filing of the application no additions to the application are allowed, only limitations.

  • Application submission

    The filing of the application at the appropriate Trademark Office (Greek TMO for national applications and the EUIPO for EUTMs).

  • Che

    The application will pass successively from the Auditor (formal requirements), the Researcher (for the identification of prior similar/identical trademarks) and the Examiner (for the examination of any absolute grounds for refusal)

  • Publication

    If the Examiner does not identify an absolute ground for refusal, the trademark will be accepted, and will be published on the GTMO's webiste. If the Examiner objects to the registration of the mark, he will notify the applicant who is allowed to submit its observations.

  • Registration

    Should 3 months from the publication of the mark lapse without an opposition having been filed by a third-party, then the mark will be registered. Otherwise, the opposition will be examined by the Administrative Trademark Committee.

  • Renewal

    Prior to the 10th anniversary from the filing of the application, the mark will have to be renewed by filing an application and paying the associated fees.

  • NATIONALLY VIA NATIONAL MARKS
    The filing of an application in each country of interest is required.
    It is of interest, if the territorial scope of your commercial interest is limited to one or two countries (e.g. Greek market)
  • EU-WIDE VIA AN EUTM
    One application is filed centrally with the European Union Intellectual Property Office (EUIPO) that covers all the countries of the EU.
    It is of interest, if the territorial scope of your commercial interest covers more EU countries (e.g. through exports)
  • INTERNATIONALLY VIA AN IR
    One application is filed centrally with the World Intellectual Property Office (WIPO) which is then branched out to national filings.
